Sprint tries to have lawsuit dismissed but fails

iPCS Inc filed a lawsuit against Sprint Nextel Corp, claiming Sprint’s proposed deal with Clearwire Corp and other partners with a view to create a national high-speed mobile internet service will violate exclusive iPCS agreements they have with Sprint.

Sprint Nextel Corp tried to have this lawsuit dismissed, however the Illinois judge has refused to dismiss the lawsuit which would stop Sprint Nextel Corp’s plans to create a next generation wireless network.

iPCS Inc filed the lawsuit in May; Cook County Judge Kathleen M. Pantle, denied Sprints motion for dismissal. Sprint is believed to begin roll out of the network this month.
