Android name causes Google to be sued?

According to a report on Forbes, Erich Specht, the owner of Android Data Corp is suing Google to the tune of $100 million along with a threat of pulling all Android branded mobile phones.

Obviously this kind of talk is usual when suing for trademark infringement, which is what Specht is claiming, and well he has owned the Android Data trademark since 2002, so no doubt Google will settle out of court on this one.

Apparently Google before launching Android wrestle with the patent office to get hold of Android and was eventually suspended from making further efforts, so why has it taken Specht so long to file? Apparently he was confused over hardware and software, and as it is software he does have grounds.
