iPhone 4 Antenna Issue Leads to Legal Action

Apparently David C Purdue of Tennessee along with other iPhone 4 customers have taken legal action against Apple claiming the iPhone 4 is a faulty device and have asked from damages of $5,000,000 to cover their costs.

According to an article over on Techeye by Andrea Petrou, the court papers claim tha David c Purdue purchased an iPhone 4 about the 6th of July from an AT&T store in Franklin Tennessee for his personal use and paid approximately $200, and said he decided to buy an iPhone 4 after watching Steve jobs San Francisco video presentation.

However apparently the papers also say that Purdue saw the familiar story that “Apple had been rubbishing,” and Purdue began experiencing “extremely poor reception with his iPhone immediately after purchase.”

A quote from the legal document says…”Such poor reception has lead to, among other things, frequent dropped calls and inability to stream video. In addition, because of the position of the phone’s antenna, if Plaintiff holds his iPhone in his left hand the problem is compounded. Plaintiff attempted to return his iPhone, but an AT&T representative told him that he would be subject to a 15 percent restocking fee.”

Now we all know the iPhone antennagate issue and how Apple is moving forward by offering every iPhone 4 user a free bumper case, and apparently Purdue purchased a bumper hoping it would solve the issue.

However apparently Purdue isn’t satisfied and in the papers he claims “Apple did not act with due care when designing, manufacturing, marketing, and selling the defective iPhone 4,” and further claims Apple has “failed to use due care by failing to issue a voluntary recall, by failing to waive the restocking fee for returned iPhone 4’s, and by failing to refund monies for service contracts where the bargained-for service is not provided.”

    Analysts estimate APPL to lose $175 million dollars for giving away free bumper cases for all iPhone 4 owners to alleviate the antenna design flaw. This lawsuits adds another $5 million to Apple's woes. Apple could lose $180 million in addition to class action lawsuits around the United States that will make that figure soar even higher.

    APPL stocks so far is underperforming as it still remains lower than the initial stock price during iPhone 4's launch. Analysts predict APPL shares to plunge as low as $230 with all the bad press and negative publicity surrounding the antenna design flaw including Consumer Report's firm position in not recommending buying the iPhone 4 across billions consumers and it's subscribers.

      Market shot, where are you getting your updates? Maybe from the cartoon that comes with the purchase of Boozuka bubble gum. Apple stock is up over $3.00 per share for this quarter alone.
      The guy who filed this lawsuit is an idiot. Apple has already stated that you can retrurn you iphone for a full refund at the Apple store without paying the restocking fee. Once the phone is returned your contract is either cancelled or it reverts back to what it was before the extention. In my case I returned my phone, got a full refund, and my contract reverted back to the original contract which expires August 6th. So this guy is just wasting the courts time with this BS lawsuit.

  2. Making steps to refund cases wont make up for the lack of function over form.

    It's a shame to see so many issues with the iPhone 4 after so many people waited for it's release. What's more of a shame is that it seems Apple knew about some of these issues already, such as the problem with reception.

    If a brand new company brought out a product and then told you needed to pay a further £25 to make it work properly, you wouldn't bother. But Apple have created such a loyal following that people may just put up with what issues there are for the sake of owning the latest Apple product. Personally, I'd be happier with an older iPhone – at least then the issues are all ironed out.

    However, it's also interesting to see how much excitement new technologies can bring. New technology and innovation is important for new business, illustrated by entrepreneurship grants and new business competitions like http://www.ukesnc.com.

    Guess it's not all bad!
