iPhone 5 and iPad 3 Samsung Demand Is Harassing Says Apple

You are probably aware of the legal wrangle going on between Apple and Samsung with Apple saying that Samsung has copied the looks and feel of the iPhone and Apple iPad in their products, and that Apple demanded samples of Sammy devices and in retaliation Samsung demanded samples of the iPhone 5 and Apple iPad 3.

Well apparently Apple has now responded to Samsungs demands by stating in an official court doc that Samsung “attempts to harass us” by requesting to see unreleased Apple gear according to the guys over at 9to5 Mac and by way of FOSS patents blog.

According to the court document Apple also labels Samsung as “the copyist,” and that the Apple suppliers demands are “not in good faith.” Apple claims that, as no future iPhone or iPad products are an issue in their complaint there is no good reason to show them to Samsung.

Apple states they don’t claim that Samsung products don’t infringe future products but rather existing ones and further states that Samsung’s request to see the iPhone 5 and Apple iPad 3 go beyond the request made by Apple, which the court granted.

I can kind of understand Apple’s claims that their future products aren’t in question, but then basically I think all this legal action over the look and feel is somewhat childish as let’s be quite honest here, every tablet and smartphone’s look and feel can be compares with any other, not just Apple gear. So my view is for both to drop all these legal tit-for-tat shenanigans and get on with deliver great devices to the public, agree or disagree?

I think Samsung are fully justified. After all what Apple is saying to Samsung is design yours so that they dont look like mine but I wont tell you what mine look like. Given th physical constraints of a phone there are not a lot of things that can be done and still stay cool. So if Samsung goes ahead and makes a cool design it WILL loke somewhat like Apple’s design so the only way to avoid the same is to have the Apple designs available and then Samsung can avoid them. Or Apple can drop its childish lawsuits against the people who are providing their LCDs and CPUs. What does Apple hope to achieve free parts for the iphone 5?
