iTunes Sync Wars: Has Palm lost to Apple?

The USB-IF has rejected Palm’s claims against Apple that they violated USB-IF policy, which isn’t very surprising really, and so pcword wonders what Palm’s next move may be.

Is there anything else Palm can do to keep in sync with iTunes? Palm still touts Media Sync which is kind of misleading as iTunes 9 breaks Media Sync.

Should or can Palm win the syncing battle? Maybe it is time for Palm to wave the white flag and drop any references to media Sync or maybe introduce a new Media Sync 2 which possible uses middleware to handle the syncing.
So what are your views, should Palm surrender any sync with iTunes?
